At the beginning of this year, he was under a lot of pressure in the office. I had to work till late night for almost a day. While doing this, one day he fell asleep in the office for a while. It is reported that Zhang was caught sleeping on CCTV. After two weeks, the HR department gave a report about him. According to the report, “Zhang was seen sleeping in the office due to exhaustion”. The young man had to sign it. After that the questioning started. Why did you sleep, how long did you sleep, asked to know. Zhang said that he fell asleep because he worked late into the night. He slept like an hour.
After that, the company talked to the labor union and fired Zhang. The notice said, ‘Zhang’s behavior is contrary to the rules and discipline of the office. Such behavior will not be tolerated at all’. At first, Zhang did not believe that the company in which he worked for a long time, worked day and night, could treat him like this. After that he took legal action.
After examining Zhang’s application, the court said that an organization can terminate an employee for violating the rules. But there are some criteria in this case. It is important to find out how much damage the organization has caused due to the employee’s behavior. If one day an employee falls asleep for a while in the office, it does not cause a huge loss to the organization at all. Zhang has worked in that company for more than 20 years. He has a good work record, timely increments, promotions. Therefore the decision to dismiss him for falling asleep is excessive and unreasonable. The court then ordered the company to pay Rs 41.4 lakh (in Indian currency) as compensation to Zhang.
